The petitioner takes exception to the order passed by the learned District Judge issuing notice on the application filed by the respondent No.1 under Section 34 of the Arbitration and Conciliation Act, 1996. According to the petitioner, the application under Section 34 of the Arbitration and Conciliation Act is barred by limitation, and without examining this aspect, the learned District Judge has directed issuance of notice. Considering the nature of order and the stage of proceedings, I am not inclined to interfere with the impugned order. The petitioner will be at liberty to raise objection / objections raised in the present petition before learned District Judge.
With the above observations, the writ petition is disposed. No costs.
