Heard.
The applicants, apprehending arrest in connection with crime registered against them for offence punishable under Sections 65(a) and 83 of the Maharashtra Prohibition Act and Section 188 of the Indian Penal Code, seek pre-arrest bail.
According to the investigating agency, on getting information a raid was conducted at Mokshadham, on seeing the police men the accused ran away, however, stock of liquor and two wheelers were seized from the spot.
The application is opposed on the ground that the applicants are habitual offenders and crime for similar offences are registered against the applicants earlier also. It is submitted that prima facie it appears that the applicants are involved in the commission of the crime as the vehicles seized from the spot are owned by the applicants. According to the investigating agency,
2 aba354.17 custodial interrogation of the applicants is required for further investigation.
Considering the facts of the case, I am not inclined to grant the prayer made in the application. The application is dismissed.
The applicants shall surrender within one week, failing which note of their conduct shall be taken at various stages of the proceedings.
