This is an application in terms of Section 407 of the Code of Criminal Procedure seeking transfer of criminal complaint No. 3430/2017 pending on the file of Judicial Magistrate First Class, Chandrapur to the Court of Judicial Magistrate First Class, Nagpur. The transfer is sought on the ground that presently both parties are staying at Nagpur and it is convenient for them to proceed at Nagpur Court.

Learned counsel for the non-applicant conceded the position and submitted that nonapplicant has no objection to transfer the concerned criminal case at Nagpur.

In view of above, criminal complaint No. 3430/2017 pending on the file of Judicial Magistrate First Class, Chandrapur is hereby withdrawn and transferred to the Court of Judicial Magistrate First Class, Nagpur.

Application stands allowed and disposed of.
