After hearing the learned Counsel for the applicant to some extent and after going through the investigation papers it reveals that 13 years girl was subjected for sexual assault by the present applicant who is a grown up man, therefore, I have shown my disinclination to grant bail to the present applicant. 3.

In view of that, learned Counsel for the applicant seeks permission to withdraw the application with direction to the expedite the trial.

Permission is granted to withdraw the application.

The application is disposed of as withdrawn.

The Special Court shall expedite the trial.

Liberty is granted to the present applicant to move before the Sessions Court if there is no substantial progress in the trial within nine months.
