By order dated 31st August 2020 this Court directed issuance of bailable warrant against the respondentaccused to secure his presence before this Court. Today, the office note shows that the report of execution of the bailable warrant is awaited.

When the matter was called-out in the morning session, the learned A.P.P. was asked to take instructions. Now, when the matter is called-out in the afternoon session, the learned A.P.P. informed that as per the report sent by the Sessions Court, the sole respondent-accused-Khemraj Bhasu Pawar is reported to be dead. A copy of Death Certificate is also placed on record showing that the sole respondentKhemraj Bhasu Pawar died on 27th January 2008. Legal Representatives of the respondent-accused have not taken any steps to come on record.

In the above facts, nothing survives in the appeal as it stands abated.
