Alleging non-compliance of direction contained in clause (c) of operative order of this Court dated 22.4.2015 in Criminal Application (APL) No.671/2012 and Criminal Application (APL) No.675/2012, original complainant has filed present contempt petition. Contempt Petition has been filed in June-2016 and this Court issued notice to respondent no.2-Police Station Officer, City Kotwali Police Station, Akola only on 21.9.2016. On returnable date i.e. on 10.10.2016, the learned A.P.P. on behalf of the respondent no.2, sought further time, as it was opposed by Advocate Joshi, while granting time till today, we kept it open for respondent no.2 to comply with the Court directions.
Today, the learned A.P.P. has produced a communication, dated 24.10.2016 sent by Police Inspector, Police Station City Kotwali, Akola to office of Government
2 cp227.16.odt Pleader, informing that "A" summary has been submitted on 14.7.2015 with Sub-Divisional Police Officer and after approval by that authority, it has been now filed in the Court of Judicial Magistrate, First Class at Akola. We take copy of communication on record as Exh. 'A'. Its copy be also supplied to Advocate Joshi.
Advocate Joshi is seeking time to verify the facts. However, in view of communication at Exh. 'A', without observing anything on merit and keeping all rival contentions open, we dispose of the contempt proceedings. JUDGE JUDGE Gulande, PA
