When the matter was called out in the morning sessions, the Advocate for the petitioner was absent. The matter was again called out at 3:10 p.m. The Advocate for the petitioner is absent.

This application has been made for clubbing of five crimes and the cases arising out of the said crimes together for trial. It is seen that in some of crimes the investigation is in progress and in some of the crimes the charge-sheets have already been filed. In these cases, the majority of the evidence is in the form of the documents.

I have gone through the application and the reply filed by the learned APP. On going through the same I am of opinion that the clubbing of all the matters would not serve the purpose of prosecution. On the contrary, the clubbing of the matters may cause inconvenience to the prosecution and the witnesses. Considering the serious nature of the crimes, the prosecution would be required to take appropriate care and see that the proper evidence is adduced in each and every case separately. The clubbing of all such matter apart from causing inconvenience to the prosecution and witnesses, can give rise to the confusion. In my view, it would not be in the interest of the informant and the accused. As such, I do not see any substance in the application.
