A report has been lodged by the Tahsildar, Barshitakli stating that two vehicles namely a JCB and a Truck were seized while illegally excavating murum. It is alleged that despite vehicles were seized, during night hours at the instance of the applicant, who is owner of both the vehicles, two co-accused have moved the property from the possession of police station, and therefore, the offence of theft. 3.

It is submitted that during the course of investigation, both the drivers were arrested, as well as both vehicles were again surrendered and seized. 4.

The prosecution has conceded that now

Order 2010aba518.21 both vehicles are again seized by the police. The applicant has also attended the police station. Having regard to the nature of accusation, applicants liberty can be protected. Hence, the following order. (i) Criminal Application is allowed and disposed of.

(ii) Interim order passed by this Court on 18.08.2021, is hereby made absolute on the same terms and conditions.

(iii) The applicant/accused to continue to attend the police station till the filing of charge sheet or 60 days, which ever is earlier.
