The applicant is arrested in Crime 66/2017 registered at the Police Station Ramdaspeth, Akola for offence punishable under section 394 and 395 of the Indian Penal Code and is in custody since January, 2018. The role is attributed to the present applicant is that he is the brother of the accused Akash Ramesh Mahato and was to dispose of the stolen property.

The submission of the learned counsel Shri Thakur is that three of the co-accused who have played a more significant role are granted by the Sessions Judge, Akola vide order dated 15.06.2018 in Misc. Criminal Application 391/2018. The learned Shri T.A. Mirza states that the material against the present applicant is the statement of the co-accused.

In the light of the accusations and the material on record this application shall have to be allowed,

The applicant shall be released on furnishing personal bond of Rs.15,000/- with a solvent surety of the like amount.

The applicant shall not tamper with the evidence nor shall applicant directly or indirectly attempt to influence the witnesses in any manner.

The applicant shall scrupulously attend the dates of hearing.

The application is disposed of accordingly.
