The present petition arises out of the order dated 02/02/2021, passed by the Additional Commissioner, Nagpur Division, Nagpur in Revision Case No.42/US-44/2019 of Village Gorepeth, Taluka and District Nagpur, filed by the present petitioner under Section 44 of the Maharashtra Rent Control Act, 1999. By the said order, the learned Commissioner has refused to entertain the revision on the ground that there was no general or special order issued by the State Government conferring revisional jurisdiction on the said authority.

The learned Assistant Government Pleader, on instructions, from the respondent No.3 makes a statement that the revisional powers have been delegated on the learned Additional Commissioner.

In view of the above, the order dated 02/02/2021 passed by the learned Additional Commissioner is quashed and set aside. Revision Case No.42/US-44/2019 of Village Gorepeth, Taluka and District Nagpur is restored to the file of the learned Additional Commissioner, Nagpur Division, Nagpur. Parties are directed to appear before the Revisional Authority on 24/11/2025. Parties to note that separate notice for appearance will not be issued.

There is a joint request by both the learned Advocates to direct the Revisional Authority to expedite the hearing of the revision since it pertains to the year 2019. 5.

Request is reasonable. The learned Additional Commissioner, Nagpur Division, Nagpur is directed to decide the revision as early as possible and in any case on or before 30/04/2026.

The writ petition is partly allowed and disposed of accordingly. No order as to costs.
