Considering the facts and circumstances of the case the following order is passed.

The trial Court shall endeavour to decide the application filed by the respondent no.6 - bank under Order 7 Rule 11 of the Civil Procedure Code (for short 'CPC') within a period of four weeks from the date of receipt copy of this order.

In the event the trial Court refuses to reject the plaint, then the trial Court shall decide the application filed by the present petitioner under Order 39, Rules 1 and 2 of the CPC for temporary injunction at Exhibit-5 within a period of four weeks from the date of passing order on the application under Order 7 Rule 11 on its own merit without being influenced by the finding, if any, recorded in the order passed below Exhibit-13.
