It is stated on behalf of the petitioner that due to the subsequent development, the cause for filing the writ petition would not survive. It is stated that by the agreement of the parties, an arbitrator was appointed and the matter was accordingly referred to the arbitrator. It is stated that the arbitrator has passed the Award.

In view of the statement made by the learned counsel for the petitioner, the writ petition is disposed of with no order as to costs.
