The petitioners are permitted to withdraw this petition with liberty to approach the Debts Recovery Appellate Tribunal.

By way of interim order dated 29th May 2019, this Court had directed the petitioners to deposit an amount of Rs. 24 lakhs with the respondent no.2 and an amount of Rs. 5 lakhs was directed to be deposited in this Court on or before 10th June 2019.

The petitioners have deposited an amount of Rs. 5 lakhs in this Court and an amount of Rs. 13 lakhs with the respondent no.2-financial institution.

The respondent no.2 is permitted to withdraw the amount of Rs.5 lakhs deposited in this Court. We continue the interim order passed by this Court for a further period of fifteen days from today and the deposit of the balance amount shall be the condition precedent for DRAT to entertain the Appeal.
