Shri Kulkarni, learned Counsel appearing for respondent nos. 5, 7 to 9, has raised a preliminary objection about existence of an alternate efficacious remedy of filing an Appeal under Section 9 of the Maharashtra Employees of Private School (Conditions of Service) Regulation Act, 1977. He submits that the orders under challenge are of termination of service and what ever issues are required to be dealt with to

Order 1406wp3807.19 judge the validity of termination, can be gone into by the School Tribunal.

In view of the aforesaid submission, Shri Khapre, learned Counsel for petitioners seeks permission to withdraw the Writ Petition with liberty to approach the School Tribunal. Hence, permission is granted to withdraw the petition with liberty to approach the School Tribunal. Needless to mention that all questions raised in the present petition are kept open.
