Rule. Ms N.P.Mehta, learned Assistant Government Pleader, waive service for the respondent Nos.1 and 2. Service on the respondent No.3 is dispensed with considering the nature of relief proposed to be granted.

The petitioner was serving as Associate Professor with the respondent No.3 - College and attained the age of superannuation on 30.6.2017. The petitioner seeks benefit of Annual Increment that is admissible from 1.7.2017. The petitioner seeks to rely upon the judgment of this Court in Writ Petition No.5864 of 2019 (Pandurang Vithobaji Dhumne and ors vs. The State of Maharashtra, through its Secretary, Rural Development, Bandhkam Bhavan, 25, Marzban Road, Fort, Mumbai-400001.) decided on 2.3.2022. The petitioner's representations dated 15.12.2021 and 18.1.2022 seeking such benefit are pending before the respondent No.2. 3.

In these facts, the respondent No.2 shall decide the aforesaid representations considering the law as applicable within a period of four weeks from the receipt of copy of this order. The .....2/-
