DATED : 14/06/2019 Heard learned Advocate Shri Meshram for the applicant and learned APP Ms. Haider for the State/non-applicant. The application for anticipatory bail is rejected by this Court on 30.04.2019. Thereafter, Criminal Application No.(ABA) no. 322 of 2019 was moved before the Court and notice was issued. On 11.06.2019, another bench of this Court has directed the Registry to place this application before this Court. The detail reasons were recorded by this Court while rejecting Criminal Application (ABA) No. 264 of 2019 decided on 30.04.2019. Robin Meshram, who alongwith the present applicant cheated many persons by saying that they will arrange admissions for M.B.B.S. course.

The complainant approached to the police station, but cognizance was not taken, therefore, he was compelled to file

2 aba 322.2019.odt application under Section 156(3) of the Criminal Procedure Code before the Judicial Magistrate First Class, Court No. 5, Nagpur. As per the directions of Judicial Magistrate First Class, offence is registered against the present applicant and Robin. As per the grievance of the complainant, Robin and present applicant received Rs.20,00,000/- for arranging the admission for M.B.B.S. Course. This Court has observed in Criminal Application (ABA) No. 264 of 2019 that the present applicant and Robin accepted Rs.30,00,000/- from one doctor for arranging the admission for his son. It appears that they are running syndicate and cheating many persons. Applicants cannot be said to be innocent. He went to Nashik alongwith Robin. There was no reason for him to go to Nashik. Hence, it appears that he is involved alongwith Robin for cheating many persons. Hence, the application is rejected. JUDGE SMGate
