This application is for seeking condonation of delay of 29 days caused in filing appeal challenging the order of acquittal dated 04.03.2021 passed in Sessions Case No. 76/2016. The learned counsel appearing for the applicant would submit that by virtue of direction issued by the Supreme Court in Miscellaneous Application No. 665/2021 in SMW (C) No. 3/2020, the said pandemic period was exempted.

Though the respondents were served and opportunity was granted, still they are absent. In view of that for the reasons stated in the application and as the period is covered by the exemption, delay stands condoned.
