By this contempt petition, the petitioner has sought action against the respondents for willful disobedience of the directions in the order, dated 01.02.2016 in Writ Petition No.3745 of 2015.

According to the petitioner, though a solemn statement was made by the learned Assistant Government Pleader appearing for the respondents that the government had called for a report from the Commissioner and after considering the strength of the students, the dispute would be resolved and the decision would be taken, no decision was taken by the respondents.

Ms Udeshi, the learned Assistant Government Pleader for the respondents, has tendered an affidavit-in-reply filed on behalf of the respondent no.1 in the Court, today. The same is accepted on record. It is stated in the reply that though there is some delay in taking the decision, the same is taken on 28.12.2016. It is stated that since the Commissioner was transferred at the relevant time, the decision could not be taken within the stipulated period. A copy of the decision is annexed to the affidavit-in-reply.

CP241-16 The learned counsel for the petitioner does not dispute that a decision is taken by the respondents in the matter of the petitioner.

In view of the aforesaid, the contempt petition is disposed of with no order as to costs.
