Hearing was conducted through video conferencing and the learned counsel agreed that the audio and visual quality was proper.
2] Issue notice, returnable on 03.11.2020.
3] Shri N.B. Jawade, the learned Additional Public Prosecutor waives service for non-applicant/State. 4] The applicant 1 is aged 64 years and his wife Mrs. Mankarna is aged 61 years.
5] The allegation which the applicants are facing is that applicant 1 is money lender from whom the deceased obtained loan and that the applicants pressurized the deceased by issuing threats etc. It is the case of the prosecution that a suicide note is recovered from the person of the deceased.
ldvcaba1409.20.O.odt 6] Considering that the investigation is not likely to be seriously hampered if the applicants are extended interim protection, till the State files its reply, the applicants can be protected.
7] In the event of arrest in Crime 245/2020 registered with Police Station Shirpur, Tahsil Malegaon, District Washim for offence punishable under section 306 read with section 34 of the Indian Penal Code, the applicants shall be released on furnishing personal bond of Rs.25,000/- each with a surety of like amount. The surety may be furnished within four weeks from the date of release.
8] The applicants shall attend Police Station Shirpur, Tahsil Malegaon, District Washim on 14th, 15th and 16th October 2020 between 11:00 a.m. to 04:00 p.m. 9] The applicants shall co-operate with the Investigating Officer.
