Heard learned counsel for the applicant.
This is a second application for grant of bail. The first bail application filed on behalf of the present applicant was registered as Criminal Application No. 52/2015, which was decided on 17.04.2015 (Coram: Prasanna B. Varale, J.). While deciding the said application, this Court observed as under:
"After arguing the matter for some time, the learned counsel for the applicant prays for withdrawal of this application with liberty to the applicant to file successive application in case the applicant is in a position to show the change in the circumstances or any other reasonable ground."
Thus, case of the present applicant was considered by this Court on its merit. Liberty was granted to the applicant to approach again in case of
ba433.15 change in circumstances. According to the learned counsel for the applicant, after rejection of the previous application, a daughter is born to the applicant and he is the only earning member of the family. However, in my opinion, this cannot be a change in circumstance.
In view of above, no case is made out by the applicant for his release on bail. The application is, therefore, rejected.
