Heard.
The applicant, whose age as per the documents on record is more than 18 years, is arrested on 18th November, 2016 in crime registered against her and her mother of the offence punishable under Sections 498-A, 307, 302 read with Section 34 of the Indian Penal Code on the accusations that the accused have poured kerosene on the person of deceased Sau. Durga (wife of applicant's brother) because of which deceased sustained injuries and died.
The application is opposed on the ground that there is material against the applicant showing her involvement in the crime.
The co-accused - mother of the applicant is released on bail on 29th November, 2016. The charge-sheet is filed. The non-applicant has not been
2 ba482.17 able to show that custody of the applicant is required for further investigation. Considering the facts of the case and the age of the applicant, in my view, the applicant is entitled to be released on bail.
Hence, the following order:
The applicant having been arrested in Crime No.183/2016 registered by the non-applicant, she be released on bail on furnishing P.R. bond for Rs.20,000/- (Rs. Twenty Thousand) and two solvent sureties in the like amount.
The applicant shall attend the trial before the Sessions Court on every date unless granted exemption by the Sessions Court.
The application is allowed in the above terms. JUDGE Tambaskar.
