Shri Dhabe, the learned Counsel for the appellant, on instructions, seeks leave to withdraw the appeal. However, the prayer is to permit the appellant to retain possession of the suit property till 31.05.2019. The request is reasonable. However, Shri Kasat, the learned Counsel for the respondent submits that till the possession is not handed over to the respondent, the appellant should continue to pay the occupation charges.
2] Shri Dhabe states that the amount is being deposited in the Executing Court and the appellant shall continue to do so, till he vacates the suit property. The statement is accepted.
3] The appeal is disposed of as withdrawn.
