After hearing the learned Senior Advocate for the applicant, I expressed that, at this stage, I am not inclined to grant prayer made in the application and I am inclined to direct the sessions Court to conclude and dispose the trial within stipulated time.

On this, the learned Senior Advocate made a grievance that in the counter case i.e. Crime No. 282 of 2016 the Investigating Agency has not filed chargesheet. The learned Senior Advocate further expressed that the chargesheet will not be filed in the other case. On this, the learned Additional Public Prosecutor sought instructions from the Investigating Officer and a specific statement is made that the chargesheet in Crime No. 282 of 2016 would be filed, in any case, within two months. The learned Additional Public Prosecutor has further submitted that the Investigating Agency intends to file supplementary chargesheet in Crime No.281 of 2016 and that will also be filed, in any case, within two months.

2 ba483.17 On this, the learned Senior Advocate has sought permission to withdraw the application with liberty to file fresh application on filing of the chargesheet. The application is dismissed as withdrawn with liberty to the applicant to file fresh application after filing of the chargesheet.

It is clarified that if the Investigating Agency fails to file chargesheet till 8th August, 2017, in Crime No.282/2016 the applicant will be at liberty to file fresh application.
