The only reason for condonation of delay is given that his Counsel was not advised him to file cross objection in the matter as the finding of Appellate Court against point No.3 is against the cross objector.

The application is vehemently opposed by appellant-respondent in cross appeal.

It is submitted that there is deliberate delay in filing cross appeal.

I have heard both the parties. I am satisfied that there is justifiable reason for not filing cross appeal within limitation. As such, the application is allowed. 5.

Delay in filing cross appeal is hereby condoned. 6.

Registry is directed to register the cross appeal. 7.

Learned Counsel wishes to argue on additional substantial question of law. He is at liberty. 8.
