By this writ petition the petitioner has sought the stepping up of his pay to the higher scale from the date on which his junior Miss R.R. Pathak was granted the said benefit. Shri Maldhure, the learned Assistant Government Pleader appearing for the respondent nos.1 and 2 states that the petitioner satisfies the criteria for seeking the stepping up of his pay to the next scale. It is admitted that Miss R.R. Pathak, who is junior to the petitioner was granted the benefit though she has secured the Ph.D after the petitioner had secured the same. In view of the statement made by the learned Assistant Government Pleader, the writ petition is allowed. The respondents are directed to step up the pay of the petitioner in tune with the pay of Miss R.R. Pathak, whose pay has been refixed by granting the said benefit to her. The respondents should refix the pay of the petitioner within two months and pay the arrears to the petitioner within two months thereafter. Order accordingly. No costs.
