DATED : 18 -10-2024 Dr. De, learned counsel for the Official Liquidator submits that in terms of the order dated 9-8-2024 passed by this Court, the payment of compensation has been made.

Learned counsel for the Official Liquidator seeks time to file reply to the show cause notice dated 4-10-2024. He further submits that the Official Liquidator is not pressing for order below Official Liquidator Report No. 6/2023 and seeks liberty to file fresh application/official liquidator report in this regard. Learned Assistant Government Pleader (AGP) submits that in compliance to order dated 9-8-2024, the Department has also released the compensation amount. Out of 11 persons, the amount of compensation has been credited to the accounts of 10 persons. The amount to 11th person could not be credited because of incorrect name. Steps are being taken to remit the amount to him.

2 olr 6.2023.odt He has then invited my attention to paragraph no. 24 of the order dated 9-8-2024 whereby the Collector, Sub Divisional Officer and Naib Tahsildar of Chandrapur were called upon to show cause why amount of compensation should not be deducted from their salaries. Learned AGP submits that the officers have submitted a detail reply in this regard and have tendered unconditional apology. Learned AGP submits that the officers have assured of being careful in future and have requested to accept their apology and not to deduct the amount from their salaries.

I have gone through the reply filed by these officers. The officers have realized their mistake, which though was inadvertent, caused serious repercussions to innocent persons. The officers have given assurance of being careful in future. The officers have also tendered apology. On the basis of assurance so given and considering contents of reply, the apology is accepted. The show cause notice is accordingly dropped. No further order is required.

Official Liquidator Report No. 6/2023 is accordingly disposed of with liberty as prayed by the Official Liquidator.

Company Petition No. 5 of 1995 List on 22-11-2024 for passing further orders, once the report of Official Liquidator on show cause notice is received. The report be filed by all the officers
