Having regard to the order made in Civil Application (CAO) No.784/2021, even this Civil Application (CAO) No.786/2021 is allowed and Misc. Civil Application (St.) No.9803/2021 is allowed and the delay seeking restoration of First Appeal No.746/2018 is condoned and the First Appeal No.746/2018 is restored to the file of this Court. 3.

Similarly, the pursis for withdrawal of First Appeal No.746/2018 is accepted and this First Appeal is disposed of, as withdrawn.

The appellant/applicant will be entitled to refund of court fees in terms of the admissible rules.

The amount which the appellant/applicant have deposited in this Court can now be withdrawn by the claimants along with the accrued interest.

The registry to take steps to transfer this amount to the bank account of the claimants as may be indicated by them.
