Shri N.R. Saboo, Advocate for the petitioners states that the impugned order is appeallable under Section 96 of the Code of Civil Procedure and seeks permission to withdraw the petition with liberty to file appeal. Shri C.H. Sharma, Advocate for the respondents / caveators has no objection for withdrawal of the petition, however, opposed the prayer for grant of liberty contending that the appeal would not lie against the impugned order. Be that as it may, the petitioners are permitted to withdraw the petition with liberty to avail alternate remedy if available as per law.
