The applicants are arrested in crime registered against them and other accused for the offences punishable under Sections 302, 143, 147, 148, 149, 506 of IPC and Section 3/25 of the Arms Act.
According to the Investigating Agency, applicants were in the assembly when complainant and her husband were asked to come out of their house and were threatened. The names of the applicants appear in the supplementary statement of Kesri Danu Mattami recorded on 2nd December, 2016. The incident is of 16th March, 2016.
The applicants claim to be labours and have stated that they are not involved in any other crime/offence earlier. The Investigating Agency has not controverted the claim of the applicants. The charge-sheet is filed on 23rd March, 2017. The non-applicant has not been able to show that the custody of the applicants is required for further investigation.
In view of the facts of the case, I am of the view
2 ba494.17 that the non-applicant should be directed to release the applicants on bail.
Hence, the following order :
i] The applicants, having been arrested in Crime No. 19 of 2016, registered by the non-applicant, they be released on bail, on furnishing P.R. Bond of Rs.25,000/- each and two solvent sureties in the like amount for each of the applicants. ii] The applicants shall attend the proceedings before the Sessions Court on every date unless granted exemption by the Sessions Court.
The application is allowed in the above terms. JUDGE PB Patil..
