The appellant, who is the original complainant, has challenged the judgment and order, passed on 9.05.2022 by the learned 7th Joint Civil Judge Junior Division and Judicial Magistrate First Class, Amravati, whereby the respondent came to be acquitted for the offence punishable under Section 138 of the Negotiable Instrument Act, 1881.

The learned Advocate for the appellant submits that the appellant has good case on merit. The learned Advocate submits that the evidence adduced by the appellant has not been properly appreciated by the learned trial Judge. The learned Advocate submits that therefore leave to file appeal against Judgment and order may be granted. 3.

In view of the facts and circumstances placed on record, leave to file appeal against the impugned Judgment and order is granted. Appeal be registered.

The learned Advocate for the appellant submits that two weeks' time may be granted to remove office objections. Time, as prayed for, is granted. 5.

In case the office objections are not removed within two weeks, the appeal shall stands dismissed without reference to the Court.

If the office objections are removed within two weeks, issue notice to the respondent, returnable within four weeks thereafter.
