By this contempt petition, the petitioner seeks action against the respondents for non-compliance of the solemn statement/ undertaking given by the counsel for the respondents in this Court that the appeal of the petitioner would be decided within two months. It is stated that the appeal filed by the petitioner is not decided within two months.

We find on a perusal of the affidavit-in-reply filed on behalf of the respondents that after the Chief Executive Officer heard the petitioner on 23.03.2015, the appeal was decided by the order, dated 15.06.2015. It is stated that the explanation for the delay caused in deciding the appeal is stated in the reply filed on behalf of the respondents.

On a perusal of the affidavit-in-reply, we find that the delay in deciding the appeal is not deliberate. Since the appeal is decided, it would not be necessary to proceed with the contempt petition, any further.

Hence, we dispose of the contempt petition with no order as to costs.
