The learned counsel for the applicant, after hearing for some time and on showing disinclination by this Court to grant bail, on instructions, seeks permission to withdraw the present application. However, he submits that as the whole case is based on circumstantial evidence, liberty may be granted to move afresh in case there is no progress in the trial in near future.

Permission to withdraw the application with liberty to move afresh in case there is no substantive progress in trial in next one and half year, is granted. 3.

The Criminal Application is disposed of accordingly.
