Heard.
The applicant is in custody since 21.1.2018 in connection with Crime 274 of 2017 registered with Dhantoli Police Station, Nagpur for offences punishable under section 452, 376(1) and 506 of the Indian Penal Code. Having perused the contents of the First Information Report and the statements of the witnesses particularly the statement of Ritesh who is the husband of the victim and one O.P. Singh the employer of Ritesh, I am inclined to allow the application.
It would not be appropriate to make elaborate observations on the material on record. Suffice it to say, that whether the alleged sexual contact was forced or was consensual, appears to be eminently arguable.
