By this petition, the petitioner seeks a direction to the respondent nos.1 to 3 to restrain and prohibit the respondent nos.4 and 5 from carrying out construction over the Government Land bearing Survey No.116, Sheet No.45.

Shri Dhatrak, the learned counsel for the respondent no.3, states on instructions that the respondent no.3 had carried out the inspection of the land in question through its officers and found that there is no construction on the said land, in progress. It is stated that if any construction activity is carried out on the said land, the respondent no.3 would take immediate action against the erring parties.

By accepting the statement made on behalf of the respondent no.3, which would be binding on the respondent no.3, we dispose of the writ petition with no order as to costs. JUDGE JUDGE APTE
