The applicant is seeking bail in connection with Crime No. 140 of 2021, registered with Police Station Dhantoli, Nagpur, for the offences punishable under Sections 381, 420, 188 and read with 34 of the Indian Penal Code, 1860, Section 26 of the Drugs Control Act, read with Section 3(7) of Essential Commodities Act, r/w Section 18(c), 27(c) (ii) of Drugs and Cosmetics Act.

Shri R.U. Girde, learned counsel for the applicant submits that the applicant is a lady and she is in jail for about more than one year.

He submits that, the investigation is over and the charge-sheet has already been filed, thus, further custody of the applicant is not necessary. Accordingly, he prays for grant of regular bail.

On the other hand, Shri V.A. Thakre, learned APP strongly opposed the present application. rkn

I have perused the charge-sheet and the FIR.

Considering the allegations made in the FIR about black marketing of vital drugs i.e. Remdesivir Injunction and considering the fact that, the applicant is in jail for more than one year and in view of the fact that the investigation is in complete, I am of the opinion that custody of the applicant is no more required. Accordingly, I pass the following order.

a) The criminal application is allowed.

b) It is directed that in Crime No. 140 of 2021, registered with Police Station Dhantoli, Nagpur, for the offences punishable under Sections 381, 420, 188 and read with 34 of the Indian Penal Code, 1860, Section 26 of the Drugs Control Act, read with Section 3(7) of Essential Commodities Act, r/w Section 18(c), 27(c)(ii) of Drugs and Cosmetics Act, the applicant shall be released on bail on furnishing P.R. Bond of Rs.25,000/- with one solvent surety in the like amount.

c) The applicant shall attend the concerned Police Station 1st and 16th day of each month between 10.00 a.m. to 12.00 noon, till the culmination of trial, except for the trial.

The criminal application is disposed of, accordingly.
