By this writ petition, the petitioner challenges the order of the Project Officer, Integrated Child Development Scheme, dated 10.07.2007 appointing the respondent no.2 on the post of Anganwadi Sevika on the basis that she was senior to the petitioner on the post of Anganwadi Madatnis and was, therefore, entitled to appointment as an Anganwadi Sevika.

Though the impugned order was challenged immediately, we had not granted any interim relief in favour of the petitioner. Rule was issued in the writ petition on 26.03.2009 and the prayer for interim relief was specifically rejected. In view of the said rejection, it is most likely that the respondent no.2 must be working on the post of Anganwadi Sevika for nearly ten years. The cause for filing the writ petition must have been rendered infructuous and the petitioner must not be interested in prosecuting the writ petition in view of the rejection of the prayer for interim relief. That appears to be the reason for the non-appearance on behalf of the petitioner in the Court, today.

WP3233-07 In view of the aforesaid, we dispose of the writ petition with no order as to costs. Rule stands discharged. JUDGE JUDGE APTE
