Heard.

The applicant is apprehending arrest in Crime 22 of 2018 for offences punishable under section 408, 409 and 420 of the Indian Penal Code.

The accusations against the present applicant is that he purchased 200 boxes of oil from main accused who is an employee of the complainant. The purchase is alleged to be without bills and at a discounted price. It is not the case of the prosecution that the present applicant shared a common intention with the main accused.

Prima facie, it is difficult to appreciate how sections 408, 409 and 420 of the Indian Penal Code are attracted. Be that as it may, in the light of the accusations and the material on record, I am inclined to protect the applicant.

The interim order dated 15.5.2018 is confirmed. The applicant shall abide by the conditions of the interim
