Heard learned counsel for the applicant and learned APP for the respondent/State.

The allegation is that the this applicant was present along with other co-accused when the illicit liquor was found to be contained in the Tavera vehicle. This is also on the basis of the statement made by the co-accused. There is no independent material showing any prima facie connection between the illicit liquor being transported and this applicant. Therefore, it is doubtful if the offences which are registered against this applicant would have been made out or not. Such being the case, the argument that this applicant has criminal antecedents showing involvement in offences in the past would be of no relevance. Therefore, this application deserves to be allowed.

The application is allowed and it is directed that the

interim anticipatory bail granted to the applicant on 17.6.2016 by this Court is hereby confirmed on the same conditions. Judge /TA/
