It is submitted that Ms A.P. Shete and Shri P.S. Khubalkar have started their independent practice and the brief was in the office of Shri N.W. Sambre advocate. Shri N.W. Sambre is elevated as Judge of this Court. Therefore, notice was issued for engaging another counsel and it is served. It is directed that the names of advocate Ms. A.P. Shete and

None appears for the appellant as well as for the respondent. The appeal was dismissed in default on 10 th June, 2009, however, it was restored. Considering the negligence on the part of the appellant, the appeal is dismissed with costs quantified at Rs.2,000/- (Rs. Two Thousand Only) to be deposited by the appellant with the Legal Aid Services Sub-Committee, High Court, Nagpur.
