After arguing for sometime, the learned advocate for the applicant pointed out that the claim of the Investigating Agency that the applicant is involved in crime is based substantially on the CCTV footage and according to him, it cannot be relied upon at this stage as it is sent for Forensic Science Department for opinion. The learned A.P. P. has submitted that the opinion of Forensic Science Department is expected in about six weeks.

In this background, the learned advocate for the applicant seeks permission to withdraw the application with liberty to file fresh application, if felt appropriate after receipt of the opinion of Forensic Science Department on the alleged CCTV footage.

The application is dismissed as withdrawn with liberty as prayed for.
