DATE : 05/12/2023 Present application is filed by wife for transfer of Petition No. A-289/2023, pending on the file of Family Court No.2 at Pune to learned Civil Judge Senior Division, Chandrapur.

The applicant is legally wedded wife of the non applicant. Their marriage was performed on 03/07/2021. After marriage she had been to her matrimonial house at Pune. It is her contention that she was meted out with physical and mental cruelty at the

hands of non applicant. Due to this, she was constrained to leave her matrimonial house and went to reside with her parents.

I have heard learned Counsel for the applicant as well as non applicant.

The non applicant is suffering with Cancer and medical documents are placed on record along with reply. However, in view of the fact that distance between Pune to Chandrapur is around 795 K.M., it would be difficult for even applicant to travel the same to attend the matter. As such, considering the inconvenience and hardship going to cause to the applicant, I am allowing the application and pass the order as follows.

ORDER

(i) Petition No. A-289/2023, pending on the file of Family Court No.2 at Pune, is hereby withdrawn and transferred to learned Civil Judge Senior Division, Chandrapur.

(ii) Learned Principal Judge, Family Court, Pune is hereby requested to

facilitate the transfer.

(iii) It is made clear that the non applicant is at liberty to appear through video conferencing unless the learned Judge requires his personal presence.

As such, application stands disposed of.
