Upon perusal of the reply of the prosecution and the case diary, it appears that there are no eye witnesses to the incident. The deceased had died due to hemorrhage and shock because of the injuries sustained to her vital organs. Some of the injuries were caused to the head of the deceased. The injuries may have been sustained by the deceased between 27/11/2015 and 29/11/2015. But, there were no eye witnesses to the incident. The deceased was admitted to the hospital on 01/12/2015 and she succumbed to the injuries on 02/12/2016. The F.I.R. has been lodged on 02/12/2015. The investigation made so far has not resulted in collecting any circumstantial evidence showing prima faice involvement of this applicant in the crime registered
against him. Except for recovery of motorcycle and clothes from the applicant, there is nothing available on record to provide the reason for believing that this applicant may have committed the murder of deceased, Jija. The applicant is in jail since 07/12/2015. Chargesheet is also filed. In these circumstances, no purpose is going to be served by detaining the applicant in jail for further period of time. Hence, the order.
The application is allowed. It is directed that the applicant be released on bail on his furnishing a P. R. Bond in the sum of Rs.20,000/- together with one solvent surety in the like amount on the conditions that he shall regularly attend the Court except on the dates when he exempted from appearing in the case, accordingly, he shall cooperate with the Court for expeditious disposal of the case and shall not tamper with the prosecution evidence.
