By this petition, the petitioner impugns the order of the Maharashtra Administrative Tribunal, Nagpur, dated 18/09/1998. The petitioner had filed an original application before the Maharashtra Administrative Tribunal seeking a declaration that the appointment of the respondent No.3 on the post of Lecturer in Pathology, on a post earmarked for the scheduled castes, was badin-law and was liable to be set aside. The Tribunal dismissed the application filed by the petitioner by the impugned order dated 18/09/1998. It appears that this Court had while issuing Rule, not granted any interim relief in favour of the petitioner, with the result that the respondent No.3 must have been working on the post of Lecturer in Pathology in the Government Medical College, Nagpur, for nearly twenty years, the petitioner must have lost interest in prosecuting the writ petition in the absence of any interim relief.

In view of the aforesaid, the writ petition is disposed of with no order as to costs.

Rule stands discharged.
