The petitioner, who was employee of the respondent no.4-Society working in the respondent no.5-School after having declared him surplus is posted at Kuhi, District Nagpur. Pursuant to the order dated 29th January, 2024 declaring him surplus, the petitioner has already resumed his services. However, the order of declaring him surplus is questioned only on the count that he being a disabled person suffering from 40% of disability is put to hardship by making him work at a taluka place away from his native. It is claimed that the respondent-Education Officer should have considered the posting of the petitioner as a surplus employee in the Nagpur city where he was earlier posted.

It is claimed that he has already moved a representation to that effect.

Having regard to the aforesaid submissions particularly, in view of the status of the petitioner as an handicap/disabled person, we deem it appropriate to direct the respondent nos.2 and 3 to consider the case of the petitioner on humanitarian ground by treating the present petition as a representation and take appropriate decision within a period of four months from today and communicate the same to the petitioner.

The petition stands disposed of. No costs.
