This application is filed by respondent no.1 for early hearing of petition contending that he is claiming permanency and is due for retirement in March 2018. It is submitted by Mrs. Joshi, learned Counsel for respondent no.1, that since respondent no.1 has already put in service of more than 26 years and is continued as temporary worker, this petition be heard expeditiously. Ms. Pathak, learned Counsel for petitioner, has opposed the application on the ground that interim relief was granted in favour of petitioner after hearing respondents and since respondent no.1 is working, there is no urgency.
Admittedly, earlier application filed by respondent no.1 for grant of early hearing was disposed of with liberty in favour of respondent no.1 to file similar
0308caw1254.17 2/2 application, if petition is not listed for final hearing within four months. In view of liberty granted as aforesaid, present application is filed. The petition is of the year 2013.
In the circumstances, application is allowed. The petition be shown in the caption of "final hearing" in the week commencing from 25/9/2017.
