Hearing was conducted through Video Conferencing and the learned Advocates agreed that the audio and visual quality was proper.

Heard Mrs. U.A. Patil, learned Advocate for the appellant, Shri P.S. Girdekar, learned Advocate for respondent No.1 and Mrs. Shamsi Haider, learned A.G.P. for respondent No.2.

This Court while admitting the appeal on 20/08/2019 granted 12 weeks' time to deposit the entire decretal amount. But, for the reasons stated in the application, the amount could not be deposited earlier. Permission needs to be granted.

fa.1570.19 2/2 Hence, the appellant is permitted to deposit the Demand Draft for Rs.43,82,295/- within a period of one week from today with the Registry to this Court. Respondent No.1 is at liberty to ask for withdrawal and it will be decided on merit.

The application is allowed and disposed of accordingly.
