DATED : 13/06/2019 The impugned order is passed by the Divisional Commissioner under Section 39 (1) of the Maharashtra Village Panchayats Act, 1959.

Ms. T.H. Khan, learned AGP has pointed out that the impugned order is apealable under Section 39 (3) of the Act of 1959.

As statutory remedy is available to the petitioner, I am not inclined to entertain the petition.

The writ petition is dismissed with liberty to the petitioner to avail alternate remedy, if so advised. JUDGE Ansari
