The petitioner has approached this Court on the assumption that his claim to compassionate appointment in accordance with the extant policy of the Bank of Maharashtra is denied. 02] The respondents have filed affidavit in response. We may extract paragraph 6 of the said affidavit.

"6] It is further submitted that due to outset of the COVID 19 pandemic, there was some delay on part of the Respondents in processing the application of the Petitioner as various officers of the Respondent Bank were severally infected. The said delay was totally unintentional and caused due to circumstances beyond the control of the Respondent Bank. Rather, the Petitioner himself submitted the relevant documents only after the end of third wave of the COVID 19 pandemic i.e. in April, 2022. It is further submitted that the Respondent Bank had to also verify whether the Petitioner had any other source of income as he as well as his two brothers were all married on 27/12/2019. Thus, the Petitioner's application is currently under process and will be considered subject to the available vacancies, his eligibility and the guidelines of the Bank."

926.wp.4407.22 2/2 03] In view of the statement in paragraph 6, we dispose of the petition by directing the petitioner to submit all the relevant documents including the fresh affidavit as is required under the policy to the respondents within two weeks.

04] In response to our query, learned Counsel Mrs. Nalamwar for the respondents has informed us that the petitioner is otherwise eligible and that as and when the vacancies are available, he would be considered in accordance with the seniority and all relevant factors spelt out in the policy. We accept the said statement. 05] The writ petition is disposed of. No costs.
