The applicant is apprehending arrest in Crime 36/2018 registered at Sitabuldi Police Station, Nagpur for offence punishable under section 406, 409, 420 read with section 34 of the Indian Penal Code and under section 3 of the Maharashtra Protection of Interest of Depositors (in Financial Establishment) Act and under section 45 S1 of the Reserve Bank of India Act.
The accusation levelled by one Dr. Gautam Bhaisare is that the applicant induced him to invest an amount of Rs.3,50,975/- in a chain marketing company - Vihan Direct Selling India Private Limited.
The submission of the learned counsel for the applicant is that there is no criminal complicity and indeed he is also a victim of the devious scheme. The learned A.P.P. Shri Pathan does not dispute that the applicant has also lodged a complaint against the said chain marketing company.
aba351.18.O.odt 2 Having perused the material on record, prima facie it appears that the applicant may be indiscreet and gullible or at the most highly responsible in his conduct. However, at least at this stage it is difficult to hold that any element of criminality is attached to the conduct of the applicant. In this view of the matter, I am inclined to allow the application.
The application is allowed.
In the event of arrest in Crime 36/2018 the applicant be released on bail on his furnishing a personal bond of Rs.15,000/- with a solvent surety of the like amount.
The applicant to appear before the Investigating Agency every Saturday between 10:00 a.m. to 12:00 p.m. till the filing of the charge-sheet.
The applicant shall not tamper with the evidence nor shall the applicant directly or indirectly attempt to influence the witnesses in any manner.
The application is disposed of accordingly.
