The petition can be disposed of with following order. 3.

The order of petitioner's services being placed on supernumerary post is informed to have been set aside on 03/09/2021 by judgment delivered in Writ Petition No.3421/2021 decided by Aurangabad Bench. According to the learned counsel for the petitioner in view thereof the petitioner is entitled for release of differential pay for which he has already approached to the respondent Authority. 4.

In this backdrop, we direct the respondent Nos.2 and 3 to treat the present petition as a representation of the petitioner and take a decision including that of release of benefit of increments if so admissible in law within a period of eight weeks from the date of appearance of the petitioner before the said Authority with copy of this order.

The petitioner undertakes to appear before the Authority with copy of this petition and order on 02/07/2024. 6.
